A part of our oversight function is to
- Reinforce public confidence about the effectiveness and impartiality of complaint handling by the relevant professional organisations; and
- Offer reassurance to the legal profession that disciplinary matters are being dealt with fairly and transparently
In carrying out these functions, we have powers under S 36(5) of the Legal Profession and Legal Aid (Scotland) Act 2007 (‘the 2007 Act’), to audit the relevant professional organisations’ records regarding conduct complaints remitted to them for investigation and determination.
